UPDATE: Boyfriend Indicted For Murder of Young Mother

UPDATE -- Ryan Mitchell, 28, has been indicted by a grand jury in the murder of his girlfriend, Melissa Nilson.

Mitchell was indicted for:  3 counts of Murder, 2 counts Felonious Assault,  Burglary, Assault on a police officer, Grand Theft Motor Vehicle, Failure to comply with an order or signal of police, failure to stop after an accident, and having weapons under disability.

Nilson, 26, was shot in the front yard of her home, while her 4 year old son was inside the home listening.

Mitchell is being held on a 2 million dollar bond. He is scheduled to be back in court March 6th.

Prosecutor Mat Heck said, "This defendant, who has previously been incarcerated coldly shot and killed the mother of a four year old child without provocation."

DAYTON -- As Montgomery County prosecutors approved a murder charge and a slew of other felonies for Ryan Mitchell, a brother speaks out about the sister he has lost, and the nephew he will now help raise.

"Melissa was a tough single mother that had a heart of gold," said Jonathan Nilson who is still pretty numb as the reality sets in that his sister, Melissa Nilson, is gone.

"She could touch anyone she met, it didn't matter your walk of life, color of your skin, your history, your background, she would be your friend and would make you feel better about yourself," Jonathan said.

She was shot to death on Friday at her home on Cree Avenue in Huber Heights. A neighbor watched the horror unfold and called 911.

CALLER: "I think he just shot his wife in the head. He had something and then I seen her go down, and she's laying in the yard and she's not even moving."

Melissa and Ryan Mitchell were not married, but they were dating and Jonathan says his sister was calling it quits on Friday.

CALLER: "He was out there yelling and screaming at her, and I look out my window and it looked like he was holding a gun. And then I heard something, he had to shoot her. The guy has a bald head and he took off running down the road."

Police say Mitchell, 28, crashed a car after hitting a van on Rip Rap Road. You can see him running off in police dash cam video. Police caught up with him at the bar Jackass Flats, where he was tasered before he was placed into handcuffs. Melissa's 4-year-old son was inside and heard it all, but still doesn't understand where Mommy is.

Jonathan said his nephew, "woke up this morning and was crying really for the first time today. And it took quite a bit of time to console him. Yeah, I don't really think he understands it."

A candlelight vigil will be held at 7 p.m. Friday at Vicki Lynn's School of Dance, where Melissa spent much of her childhood.

Jazz Central will host a "Celebration of Melissa's Life" this Saturday, March 1, from 6 to 10 p.m. Club Vex will then host a memorial party from 10 to close that same evening.

A fund is set up at Wright-Patt Credit Union for Melissa's 4-year-old in her name, Melissa Nilson.

Mitchell faces charges of Murder, Felonious Assault on a Police Officer, Felonious Assault, Grand Theft Motor Vehicle, Failure to Stop after Accident, Failure to Comply with Lawful Order of Police Officer, Burglary, and Having Weapon While Under Disability.
