Charges approved against father, teen brother of 2 year old accidentally fatally shot
DAYTON, Ohio (WKEF/WRGT) - Charges have been approved against the father and teenager brother of a 2 year old was accidentally fatally shot in Harrison Township.
Police said the 13-year-old defendant was playing with his father's loaded firearm that he found beneath their kitchen sink when he discharged it, hitting and killing 2-year-old J’veontae Johnston.
The teen will be formally charged with one count of reckless homicide with a firearm specification. Due to his age, he cannot be tried as an adult.
Their father, 34-year-old Jamahl Evans, will be charged with one count of involuntary manslaughter, one count of endangering children, 10 counts of having weapons while under disability, one count of possessing drug paraphernalia and one count of possession of marijuana. His previous criminal record reportedly includes one prior conviction of an offense of violence and four prior convictions for drug offenses. He was on probation at the time of the shooting.
