Teen accused of accidentally fatally shooting 2-year-old brother put on house arrest
DAYTON, Ohio (WKEF/WRGT) - Tragedy struck a home on Wheeler Avenue June 5 when a 13 year old accidentally shot and killed his 2-year-old brother.
Police said the 13 year old admitted to the shooting, and is now facing a reckless homicide charge. He appeared in court Tuesday, where judge Anthony Capizzi decided to put him on house arrest. His grandmother was also granted custody, and the teen will be staying with her.
Judge Capizzi also set strict rules for the teen, which includes children not being allowed near him or his grandmother's house. "If you go out of that house and cause any kind of trouble in the community," he said, "you will be immediately picked up and kept in detention."
Jamahl Evans, the father of both boys, is still in custody at the Montgomery County Jail. He is a convicted felon, and Montgomery County Sheriff Phil Plummer said, "he totally understands he shouldn't have had a firearm."
The teen's case will continue in juvenile court, and Evans will be tried in federal court.
