Judge Denies Man Early Prison Release For Killing Stepson
DAYTON -- A Montgomery County judge denies a man's attempt to get out of jail after serving seven years for killing his 3-year-old stepson.
A judge sentenced Dennis Hollon to six to 10 years for killing Kyle Klein. Last year, after serving six years, he applied for early release and was denied. Tuesday would be his final opportunity to be released early.
The prosecution displayed pictures of bruised and injured Kyle Klein, 3, to show Judge Gregory Singer the abuse that Hollon inflicted on his step child. They wanted to make it clear that Klein suffered severe head trauma at the time of death on Dec. 15, 2006, but that he also went through several other beatings, and to make matters worse Hollon lied about how Klein died.
"In fact, there was another story about Kyle falling down and hitting a dresser," said the prosecutor.
The defense made the case that while Hollon has served the minimum time in prison for this death, he is a completely different man now than in 2007 when he was convicted of involuntary manslaughter and child endangerment. His lawyer says he sought out drug and alcohol rehabilitation and has taken several classes that will make in successful out of prison.
But that didn't matter to Judge Singer. He overruled Hollon's motion for judicial release.
"I think the most difficult part of this for the Hollon's family is they have seen Dennis and his rehabilitative efforts and they have been witnessed to the changes that Dennis has made that have been overall positive in his life," said Defense attorney Lori Cicero.
Klein's biological father told the court that he has fallen into depression since his son's death and his family has never been able to recover.
"The last thing I remember was Kyle in a casket and him getting buried," said his brother Tyler.
"I don't think that justice will ever be served for Kyle because 10 years was not long enough of a sentence," said Kyle's aunt Cybil Poole.
Montgomery County prosecutors tell us Heidi Hollon, the child's mother, was aware that her husband was abusing the boy. Heidi Hollon of Camden was sentenced to three years in prison.
