WV Teen Wearing NRA Shirt May Face Prison Time
CHARLESTON, W. Va. -- One teen now faces a year in prison following an April school suspension.
Jared Marcum, 14, was suspended for wearing a shirt that displayed a rifle and read "Protect Your Rights".
The school says Jared caused a disruption after a teacher asked him to remove it. Police were called in to handle the situation.
Jared is now facing charges of obstructing an officer. He's due back in court next month.
WV Teen Arrested for NRA T-Shirt Back to Class
CHARLESTON, W.Va. -- Just last Thursday, Alan Lardieri says his stepson's First- and Second-Amendment rights were violated after his stepson was arrested at school for wearing an NRA T-shirt.
"Every freedom-loving American was assaulted that day," said Lardieri.
And on Monday Jared Marcum returned to Logan Middle School, the first time since the incident.
That incident has garnered attention from across the country.
"I told them no, I wasn't going to change my shirt," said Marcum.
Marcum's NRA shirt reads, "Protect your rights" and displays a rifle.
The controversy began while the eighth-grader was going through the lunch line and a teacher stopped him and asked if the shirt was appropriate for school.
That's when the trouble started.
"There's nothing wrong with it and it doesn't violate the policy in any way," said Marcum. "And things got out of hand."
Logan City Police say Marcum started somewhat of a "riot" in the school's lunchroom after the teacher questioned his shirt and officers were called in to handle the problem.
Police say Marcum was eventually arrested for disturbing the education process and obstruction.
"Educational process is not lunch time in my opinion and if anyone disturbed it, it was definitely the educator and not me," Marcum said.
Marcum was arrested and suspended from school for a day.
It's a pattern of punishments Lardieri wants to see come to an end.
"A kid chewed a Pop Tart into the rough shape of a handgun and he was sent home. A kid was on the playground and he had his hands in the shape of a handgun playing cops and robbers, he was sent home. A kid actually wore an American flag shirt during Cinco de Mayo and he was sent home," said Lardieri. "This has got to stop."
CHARLESTON, WV-- A West Virginia teenager is back in class following his arrest and suspension from school after he refused to remove an NRA T-shirt.
Jared Marcum, 14, of Logan returned to Logan Middle School on Monday after serving a one-day suspension.
His lawyer, Ben White, said school administrators maintain that Marcum disrupted the educational process. He said Marcum was exercising his right to free speech and wasn't disruptive.
Logan police arrested Marcum at the school last Thursday after he refused a teacher's order to remove the shirt. White said prosecutors are reviewing the case to decide whether to proceed.
Marcum wore the same shirt to school Monday. It displays the NRA logo and a hunting rifle.
Logan County Schools Superintendent Wilma Zigmond didn't immediately return a telephone message.
